O vendedor, extremamente marketeiro, disse reinteradamente que o cabo era excelente, pois era um produto homologado pela própria apple. Ocorre que após apenas uma semana de uso, o cabo simplesmente quebrou de forma ilógica. O conector Lightning desprendeu-se do cabo e ficou preso na entrada do meu celular, gerando danos inclusive na entrada do meu aparelho. Ao comparecer na loja e solicitar educadamente a troca do objeto ou devolução do valor, o mesmo funcionário que me vendeu o produto recusou-se a efetuar a troca, além de tudo, tratou-me de forma extremamente arrogante e ostensiva. Acusou-me todo o tempo de que eu havia quebrado o carregador propositalmente, que o produto quebrou por mau uso. O vendendor, bastante infantil e pedante, quis me dar uma aula (bem ruim por sinal) sobre as leis da física, falando que eu apliquei uma força sobre o cabo, ocasionando o dano. O vendedor, além de estudar física devidamente, deveria também estudar o direito do consumidor, uma vez que as leis consumeiristas prezam pela garantia dos produtos e serviços com padrões adequados de qualidade, segurança, durabilidade e desempenho, conforme prevê o artigo 4º, inciso II, alínea d.do CDC. Além de ter ocorrido prática abusiva de propaganda enganosa, uma vez que o vendedor alega o poduto ser homologado pela apple, sendo uma inverdade, o art. 441 do CDC fora descumprido, pois o produto possuia um vício redibitório e a loja não tomou as medidas exigidas pela legislação brasileira. Aguardo minimamente a devolução do valor em que eu paguei no referido produto ou ingressarei com uma ação judicial, requerendo uma indenização por danos morais e materiais, uma vez que o meu Iphone sofreu deteriorização. (possuo provas e laudos pericionais de todo o disposto). Como é de notório saber jurídico, a prática abusiva de propaganda enganosa cometida pelo vendedor é um crime, portanto será devidamente denunciada nos órgãos de proteção ao consumidor brasileiro.
I recently bought a charger for my iphone from this store. The seller, extremely marketer, said repeatedly that the cable was excellent, as it was a product approved by Apple itself. It turns out that after just a week of use, the cable simply broke illogically. The Lightning connector came off the cable and got stuck in the entrance of my cell phone, causing damage even in the entrance of my device. Upon appearing at the store and politely requesting the exchange of the object or refund of the value, the same employee who sold me the product refused to make the exchange, besides, he treated me extremely arrogantly and ostentatiously. He accused me all along that I had purposely broken the charger, that the product broke through misuse. The seller, very childish and pedantic, wanted to give me a class (very bad by the way) about the laws of physics, saying that I applied a force on the cable, causing the damage. The seller, in addition to duly studying physics, should also study consumer law, since consumer laws emphasize the guarantee of products and services with adequate standards of quality, safety, durability and performance, as provided for in article 4, item II , paragraph d. of the CDC. In addition to an abusive practice of misleading advertising, since the seller claims the product is approved by apple, being untrue, art. 441 of the CDC was not complied with, as the product had a reductive vice and the store did not take the measures required by Brazilian law. I am minimally awaiting the return of the amount I paid for the said product or I will file a lawsuit, claiming compensation for moral and material damages, since my Iphone has deteriorated. (I have evidence and expert reports of all the provisions). As it is well-known legal knowledge, the abusive practice of misleading advertising committed by the seller is a crime, therefore it will be duly denounced in the Brazilian consumer protection agencies.
