A negativa do estabelecimento comercial em promover a compra de cigarros por meio de cartão de débito e/ou de crédito é considerada prática abusiva, que infringe as normas vigentes insculpidas no Código de Defesa do Consumidor, conforme preceitua o artigo 51, XII.
Note-se que, uma vez disponibilizadas as formas de pagamento, naquele estabelecimento comercial, como cartão de débito e/ou crédito, seu uso não pode ser restrito ou limitado. Como também não é possível fazer acréscimos no cartão ou condicionar a aceitação à compra a partir de determinada quantia.
Frise-se que o ato de estabelecer valor mínimo, recusar venda por meio de cartão de débito e/ou crédito ou cobrar acréscimo sobre o preço, enseja multa ao estabelecimento, que varia de R$ 200,00 a R$ 3.000.000,00, calculada com base no faturamento da empresa.
