★ ★ ★ ★ ★ Péssima experiência e descaso com o consumidor ! Minha mãe, a senhora Filomena de Pontes no dia 22/06/2021 foi ao estabelecimento comprar a xícara com alguns chocolates para presentear minha namorada.
Ao chegar em casa com o produto viu que a borda da caneca estava rachada (vide a foto) e, no período da tarde, foi até a loja solicitar a troca do produto foi realizar a troca no período da tarde no mesmo dia, na parte da tarde para solicitar a troca do produto. Para surpresa dela o funcionário que a atendeu disse que não iria trocar o produto, pois ela quem teria danificado o mesmo.
Quando ela me descreveu o ocorrido eu liguei para a loja, por volta das 16H30min e falei com o sr. Silvano para explicar o ocorrido, esclarecendo que por ter formação jurídica conhecia os direitos do consumidor e que o presente caso representava uma violação aos mesmos, seja pelo produto apresentar um vício, seja pela inversão do ônus da prova. O mesmo solicitou que minha mãe retornasse no dia seguinte (23/06/2021) para realizar a troca do produto.
Não passou nem 5 minutos do contato telefônico e o sr. Alisson ligou no meu telefone solicitando maiores esclarecimentos. Alegando que não haviam falado que negado trocar o produto da minha mãe, que estavam analisando nas câmeras para verificar se não foi ela quem quebrou a caneca e que não seria por "uma caneca que eles se queimariam". Veja que as alegações são contraditórias, pois se eles não negariam a troca do produto defeituoso e/ou não seria por uma caneca que eles "se queimariam" por que pediram 1 dia de prazo para analisar as câmeras?
Além disso tudo, o sr. Alisson disse que como advogado não deveria ligar no estabelecimento dando "carteirada". Ocasião em que eu esclareci que o que eu apontei foi apenas um direito do consumidor e que não se tratava de "carteirada".
Enfim, essas condutas mostram a falta de respeito ao consumidor que o estabelecimento demonstrou. Espero que isso seja um caso isolado.
Bad experience and neglect with the consumer! My mother, Mrs. Filomena de Pontes on 06/22/2021 went to the establishment to buy a cup with some chocolates as a gift to my girlfriend.
When he arrived home with the product, he saw that the edge of the mug was cracked (see the photo) and, in the afternoon, he went to the store to request the exchange of the product and exchange it in the afternoon on the same day, in the part in the afternoon to request the exchange of the product. To her surprise, the employee who attended her said he would not change the product, as she was the one who would have damaged it.
When she described what happened to me, I called the store at around 4:30 pm and spoke with mr. Silvano to explain what happened, clarifying that because he had a legal background he knew the consumer's rights and that the present case represented a violation of them, either because the product had a defect, or because of the inversion of the burden of proof. He asked my mother to return the next day (06/23/2021) to exchange the product.
It wasn't even 5 minutes after the telephone contact and mr. Alisson called my phone asking for further clarification. Claiming that they had not said that they had denied changing my mother's product, that they were analyzing it on camera to verify that she was not the one who broke the mug and that it would not be for "a mug that they would burn themselves". See that the allegations are contradictory, because if they would not deny the exchange of the defective product and/or it would not be for a mug that they would "burn" why did they ask for a 1 day deadline to analyze the cameras?
On top of that, mr. Alisson said that as a lawyer you shouldn't call the establishment with a "wallet". On that occasion I clarified that what I pointed out was just a consumer's right and that it was not a "wallet".
Anyway, these behaviors show the lack of respect for the consumer that the establishment has shown. I hope this is an isolated case.
